Attorneys cannot act as soon as everything is signed. The document must first be registered with the Office of the Public Guardian before it can be used.

This can be done at any time but we usually recommend that it is done straight away. An application form must be completed and a registration fee of £110 paid.

Notices also need to be sent to the “people to be told” named in the Power of Attorney. This element was introduced with Lasting Powers of Attorney as a safeguard.

The “people to be told” are given time to raise any concerns or objections. This means that the earliest that the Office of the Public Guardian can register the Lasting Power of Attorney is three weeks. Usually the whole process takes several weeks depending on the number of applications being dealt with by the Office of the Public Guardian.
