Compensation for Personal Injury

by Macks Solicitors

Every claim for Personal Injury Compensation is different and the awards vary according to the seriousness of the injury and the financial losses incurred.

Compensation is awarded for the following:

Pain, Suffering and Long Term Effects Awards are based upon medical evidence, usually a report from a specialist, of injuries suffered in the accident. They will take into account the pain and suffering caused and also how your injuries, or disease, is affecting you now and how it is likely to affect you in the future.

Financial Losses Any losses you incur as a result of your accident or illness are included in the compensation award . The purpose being that you should be returned to the same financial position you would be in if you had not had the accident or illness.

  • General Expenses – Any outgoings relating to the accident can be claimed for. E.g. the cost of travel for treatment, the cost of prescriptions, non prescription medicines, damage to clothing etc.
  • Loss of Earnings – Compensation will cover any loss of earnings since the accident and will take into account any future loss of earnings. In cases where the injury is serious compensation will also cover alterations to property or vehicles as well as any costs for ongoing care, including any care provided by the family.
  • Additional damages – these are awarded where a case involves a fatality. This may include compensation to any dependant relatives for the loss of the deceased’s income and time and will cover funeral expenses.

Receipts It is important that you retain all receipts for any expenses that you wish to include in your claim.
