64 holiday claims after salmonella poisoning at Costa del Sol hotel

by Macks Solicitors

Eight members of the same family from Doncaster were struck down with salmonella whilst on holiday in Costa del Sol. Many other residents at the same hotel where they were staying also suffered from gastric illness. Some cases were so serious that the victims had to be hospitalised.

The family became aware of problems at the hotel just before they travelled but were unable to cancel the trip without losing the money they had paid. But only 3-4 days into their holiday, the first family member started suffering the symptoms of food poisoning, which lasted for four days. Then other members started falling ill, including a three year old boy who needed hospital treatment upon return to the UK.

Salmonella is a type of bacteria. Food can become contaminated with salmonella if there is poor hygiene in the preparation and storage or if the food comes into contact with raw meat, poultry or infected dairy products. Symptoms of food poisoning, including salmonella, can include vomiting, diarrhoea, nausea, abdominal pains, fever, chills and muscle pains. Serious dehydration can follow.

The hotel has since been dropped by the holiday company the family used but the family have submitted a claim for compensation, saying that their experiences could have been prevented. One of the family members has suffered from Irritable Bowel Syndrome since returning to the UK and blames the bout of salmonella poisoning. The family form part of a group of 64 individuals currently making claims for compensation after staying at the hotel. Food was served buffet-style. Buffets need careful attention to avoid cross contamination from shared utensils and exposed food. However the food on this buffet was often not heated through and birds were seen in the dining room. This indicates poor hygiene procedures which are likely to have caused the problems.

Over 1000 people have made successful holiday claims after suffering from food poisoning whilst staying at this hotel between 1999 and 2006. Their claims totalled more than £2.5 million. They form just some of the holiday claims submitted every year after holiday-makers suffer food poisoning at resorts throughout the world.

A case of food poisoning can ruin a holiday which is supposed to be fun and relaxing. Financial compensation will not make up for the suffering caused but it can pay for the cost of the holiday, medical costs, lost earnings and compensate for the lost holiday and any injuries caused.

The key to a successful claim is evidence. You should make sure you have detailed evidence, including witness details if appropriate. You should also seek legal advice as soon as possible and choose an experienced and well-recommended solicitor to help you with your claim. A good solicitor will be able to advise you on the level of compensation you could expect to receive and be able to pursue your case to achieve the maximum possible payment.
