What Is a Lasting Power of Attorney?
A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint someone you trust, known as your attorney, to make decisions on your behalf if you become unable to do so in the future. There are two types of LPA:
Health and Welfare LPA
This covers decisions about your day-to-day care, medical treatment, where you live and life-sustaining treatment, but it can only be used if you lose the ability to make these decisions yourself.
Property and Financial Affairs LPA
This allows your attorney to manage your finances, such as paying your bills, accessing your bank accounts, and selling property. You can choose to allow this to be used immediately, or only if you become unable to manage things yourself.
Creating an LPA ensures that someone you trust is legally empowered to act in your best interests, avoiding delays, disputes, or the need for costly court applications if you lose capacity.
