Why Pensions Matter in Divorce

Pensions are often built over decades and can play a huge role in your financial wellbeing after retirement. Whether it’s a:

  • Workplace pension
  • Personal or self-invested pension (SIPP)
  • Public sector, police, or armed forces scheme
  • One partner’s sole source of retirement income

…it needs to be taken seriously.

If one partner has significantly more pension savings, the law allows for a fair financial settlement to ensure neither party is left disadvantaged.

How Are Pensions Divided in Divorce?

There are three main ways pensions can be dealt with during separation:

Pension Sharing Order

A percentage of one person’s pension is transferred into a new pension for the other. It’s a clean break, giving each person full control over their own retirement fund.

Pension Offsetting

One person keeps more (or all) of the pension, and the other receives different assets, such as more equity in the family home. This can be useful if one party needs access to cash sooner.

Pension Attachment Order

A share of the pension income is paid directly to the other person when it’s eventually paid out. Unlike pension sharing, this doesn’t provide a clean break and depends on when the pension is accessed.

We’ll help you understand the pros and cons of each route and guide you toward the option that’s best for your future. Call our specialist family team today on 01642 843 671 or use our contact form and we will call you back.

Specialist Advice When It Matters Most

Some pensions are complex, especially where multiple pots or high values are involved. That’s where our network of trusted actuaries and financial advisers comes in. We work alongside experts to ensure your pension is accurately valued and your settlement reflects its full long-term impact.

What If the Pension is Only in My Partner’s Name?

You may still be entitled to a share. The court considers what was built up during your relationship not just whose name is on the paperwork.

What If My Partner Won’t Disclose Their Pension?

Full financial disclosure is a legal requirement. If they refuse, we can apply to the court to compel disclosure. Hiding assets only hurts their case.

Will My Pension Be Split Even If I Was the Only One Contributing?

Possibly. Pensions accumulated during the relationship are often considered joint assets. The court aims for fairness, not just a calculation of contributions.

What If I Am Already Retired?

Pensions already in payment can still be shared or offset. We’ll help you explore your rights and any alternatives that make sense for your stage of life.
