Do Grandparents Have a Right to See Their Grandchildren?

While grandparents don’t have an automatic legal right to contact, family courts recognise the valuable role grandparents play in a child’s life. If staying in touch is in the child’s best interests, the court will consider your request.

Before applying for a court order, most grandparents need the court’s permission known as “leave to apply.” This is usually granted unless there are serious concerns or objections.

What Can You Apply For?

You may be able to apply for a Child Arrangements Order, which outlines the type of contact you can have. This might include:

  • Regular in-person visits (weekends, holidays, etc.)
  • Supervised contact if there are concerns
  • Phone or video calls, messages, or letters
  • Time on birthdays, holidays, or special occasions

In some situations, grandparents can also apply for the child to live with them, usually where parents are unable to provide safe care.

The court always puts the child’s welfare first and aims to create contact that is safe, supportive, and in their best interests.
