Sandra’s accident

Sandra purchased a new fridge freezer which had been delivered only a couple of weeks before her accident occurred.  Sandra was opening the fridge door when the door hinges became loose.  The door fell away from its hinges and fell towards Sandra, striking the left hand side of her head and face. In addition to Sandra suffering extensive bruising to her face, she also suffered a head injury and suffered headaches daily.

  • Failing to cause the fridge freezer to be checked and/or inspected before selling the same to Sandra when the door was in a defective condition.
  • Failing to ensure that the quality control system of the manufacturers from whom they purchase the fridge freezers was adequate to discover defects such as that which the caused the door to come away from its hinges.
  • Failing to warn Sandra of the danger presented by the defect.

Liability for the defendant’s negligence was admitted and compensation for Sandra was settled at £4,100.
