Brother And Sister Compensated After Separate Delivery Errors

Two severely disabled siblings have been awarded millions in compensation after the success of their mother’s 20-year legal fight.

Natasha Jackson, who is now 23, has been awarded £7m from the NHS after mistakes during her birth led to her being born with cerebral palsy. Her brother Patrick, 22, was awarded £6m in 2010 after similar errors meant he was born with the condition.

The clinical negligence cases occurred with the same maternity team at Sharoe Green Hospital in Preston, which has since been closed. It is thought to be the first compensation case where two children from the same family have been victims of clinical negligence in such a way.

Hospital mistakes and delivery errors led to both babies being starved of oxygen at birth and are now unable to care for themselves. Their mother, Paula McKay, described her devastation upon learning that her daughter was suffering from the condition and had been a victim of clinical negligence. She said it had then “ripped her heart out” when she learned that her second child had also become brain damaged during his birth.

The children’s conditions were entirely avoidable and Mrs McKay gave birth to a third child with no complications. She chose for him to be delivered at a different hospital.

Both siblings require lifelong care and Mrs McKay was forced to give up work in order to care for them. The compensation has reassured her that the children will be cared for when she is no longer able to and will not be placed in a care home, which she believed would be unsuitable for their needs.

The money will cover the costs of their current and future needs and is to be divided into funds for transport, staff and staff training, accommodation and holidays.
