Alternatives to court for separating couples – Part 1: What to expect from mediation.

During Family Dispute Resolution Week, Macks Solicitors will be offering 30 minutes free to clients who wish to discuss alternative options to resolve any issues that may arise from a relationship breakdown. Mediation is one of these alternatives.

A mediation process will enable the two parties to avoid a long court process, and instead to fix unresolved issues between them.

Mediation involves the appointment of a neutral third party mediator, who encourages the couple to reach their own agreements.  The mediator does not themselves make decisions, but instead assists the separating couple to.

It is recommended that you also have parallel legal advice during mediation – it is helpful to instruct a family solicitor from the outset.

The aim of mediation is a fair outcome to be agreed by both parties, rather than by a judge. Parties can be in control of the direction of the agreements throughout; there won’t be uncertainty over the outcome, which may occur in a court dispute.

Generally, choosing to use mediation will be cheaper than resolving issues in court, and the separating couple can split the fees charged by the mediator.

Crucially, mediation is much less stressful than a court process, as it allows you to maintain civility with your ex-partner, and avoid the emotional turmoil of court.
