Buying a Property

If you are buying a property, it is always advisable to use an experienced property Solicitor who will oversee the entire transaction to make certain that it runs smoothly from start to finish, with minimum delay.

It is important to remember that buying any type of property involves lots of questions and paperwork, such as:

Standard and supplemental pre-contract enquiries
Searches including local searches and specialist searches relevant to the property you are buying
Conveyancing
Exchange of contracts
Completion
Registration of the transfer

Exchange of Contracts and Completion

The exchange of contracts is the legal process that makes the buyer and seller legally bound to the sale and purchase. If one tries to pull out, they will be in breach of contract with financial penalties for withdrawing.

In exchange for contracts, a completion day is fixed. This can be the same day as the exchange of contracts if you are in a hurry or, if you want to be able to plan the move and book a removal company knowing that completion will definitely go ahead, it can be set for a few days or weeks later.

Once completion has taken place, a buyer’s Solicitor will sort out the registration of the transaction at the Land Registry and completion of stamp duty forms.

We’ve recently been on an 8 month journey of buying our first home. After enduring a 3 month Covid delay on our first homebuyers survey on the original house we were looking to purchase (which didn’t turn out well), we pursued a different house and managed to complete on our dream first home in York this month (October).
