What can I claim?
Slips and trips can occur in many situations including in the workplace, in a shop, in a public building, on a pavement and petrol forecourt. If you have suffered an injury as a result of a trip or fall you may be entitled to compensation. Many slipping and tripping claims result in fractures to various parts of the body (including toes, ankles, knees, wrists, hands and hips), together with bruising and sprains.
Compensation is awarded for any physical and psychological injuries (e.g. if you suffer a loss of confidence or have become anxious and depressed). Medical evidence will be obtained from an appropriate expert (e.g. Orthopaedic Consultant, Accident and Emergency Consultant, Psychologist/Psychiatrist). Once medical evidence has been finalised your solicitor will assess the value of your claim referring to court guidelines and previously decided cases which have gone to court.
In addition to claiming compensation for your physical and psychological injuries you will also be able to claim for any financial losses incurred as a result of your accident. Compensation for this will include:-
- Loss of earnings (both past and future);
- Loss of bonus or promotion;
- Travel expenses;
- The cost of aids and appliances;
- The cost of care (including services voluntarily provided by friends and relatives);
- The cost of DIY, gardening, window cleaning, that you were able to do before the accident;
- Prescription costs;
- Cost of clothes/spectacles damaged in the accident or cut off in hospital;
- Private medical treatment;
- In the most serious cases the cost of adaptations to your home.
Every claim is different and there may be other losses which can be claimed. It is up to a claimant and their solicitor to prove their losses. It is prudent to keep records as far as possible and retain any receipts, travel tickets and the like in respect of any expenses incurred.
You may also be entitled to claim state benefits as a result of your injuries, especially if you are left with a continuing disability. If your slip or trip occurred whilst at work you may be entitled to claim industrial injuries Disability Benefit.
Depending upon the nature and extent of your injuries you may be able to claim for both past losses incurred and also ongoing future expenses. For example, if you are unable to return to work due to your injury you may be able to recover compensation for your future loss of earnings; or if you are a keen gardener and can no longer care for your garden, you may be able to claim the cost of a gardener.
