What can I claim?

When your child has been involved in an accident you may be entitled to claim compensation on their behalf. The claim will be broken down into two main elements – general and special damages.

General Damages

General damages is the award of compensation made in respect of the injury sustained. There are several things taken into account when assessing the claim including the pain and suffering caused by the accident but also the loss of amenity i.e. the effect upon your child’s quality of life, including loss of opportunities in the future, disadvantage in the labour market and effect upon hobbies.

Special Damages

Special damages is the term used for financial losses arising from the accident and the injuries sustained by your child.  You will be required to provide details of all expenses you have incurred on your child’s behalf so that this can be included in the claim.  Some examples of special damages are which can be included in the claim are:-

  • Private medical treatment – the cost of medical treatment including rehabilitation and counselling. A claim will also be made for any private treatment which may be required in the future.
  • Educational needs – including assessment and additional support required (both past and future).
  • Loss of earnings – if you or other family members/friends have incurred losses as a result of an absence from work as a result of the accident this will be included in the claim.
  • Care and assistance for both professional care and care provided by friends and family, including any additional care which may be required in the future.
  • Any aids or adaptations required to the home as a result of the injury sustained.
  • Additional transport costs.
  • Items lost or damaged in the accident.
  • In the most serious cases your child’s future loss of earnings and disadvantage on the labour market together with private nursing care, physiotherapy and other related costs.

It is important that any expenses incurred are reasonable and you should always carefully follow any medical advice given, as failure to do so could affect recovery of your expenses as part of your child’s claim.
