Compensation for child left brain damaged after accident at Nursery |

The parents of a young boy have sued a variety of organisations and people on his behalf, after an accident he had whilst in their care left him with severe brain damage. James Pitcher was a mere nine months old when he fell off a changing table at a Headstart Nursery in Croydon, in August 2004; now four years old, James was so badly injured by his accident that he became quadriplegic, was no longer able to breathe properly, and has to be fed by a tube as well as requiring round-the-clock care. James father, Nigel sued not only the Headstart organisation, but also the carer whose charge his son was in and Mayday Hospital, whom he accuses of delaying their diagnosis and thus the impact of his son’s injury. All parties admitted liability so that the family were awarded a £320,000 interim payment to cover the immediate cost of their son’s care whilst a judge calculated the total amount of compensation James should receive. The money has gone towards building and modifying a new family home which is adapted for James’ needs. The full amount of compensation the child will receive, which will be revealed at a hearing around November 2009, is likely to stretch into the millions after the family’s lawyers submitted a compensation claim for £5,054,526. ![]() ![]() Newer news items:
