Compensation Claims

Car Accidents

The car still remains the transport of choice for most people despite the rise in the cost of motoring. With traffic on the roads increasing year on year it is very likely that anyone who travels regularly by car, either as a driver or a passenger, will at some time be involved in a road traffic accident.

The cause of accidents ranges from poor road or weather conditions to careless or reckless driving and because it isn’t always possible to predict how a vehicle will behave in unexpected road or weather conditions or how other drivers will act, even the very best of drivers can be involved in an accident on the road.

If you have been injured in a car accident that was the fault of someone else, either the driver of another vehicle or the driver of the vehicle in which you were a passenger, then you may be able to make a claim for compensation.

If you are unsure whether you have a valid claim for compensation you should contact Macks Solicitors for advice without obligation. Macks Solicitors is a well established law practice with a team of expert personal injury solicitors on hand to assist the innocent victims of motor accidents.

Our aim is to negotiate the very best settlement possible for our client’s injuries and to recover damages for all losses such as loss of earnings and the cost of transport for treatment etc. Our advice is free and you will keep all the compensation you are awarded so you have nothing to lose and a lot to gain by contacting Macks Solicitors.

You can contact Macks Solicitors in any of the following ways:-

  • Complete the Quick Claim Form and a specialist solicitor will contact you.
  • Dial our Freephone Number 0800 652 4321.

It could not be simpler and will not cost you a penny.

Drivers

Insurers always advise their policy holders against accepting blame for an accident so even if the driver of the other vehicle believes they caused the accident they are unlikely to admit liability. Don’t let this put you off calling for advice as Macks have settled many claims for clients where liability has initially been denied by the other party or their insurers.

Accidents caused by Uninsured and Untraced Drivers

There are a large number of people driving on the roads today without adequate insurance cover or in many cases, without any cover at all. If you have been injured in an accident caused by an uninsured driver or by a driver who leaves the scene without exchanging details, we can help you make a claim for compensation through the Motor Insurance Bureau (MIB).

It is advisable to seek legal advice from a specialist firm, like Macks, as soon as possible as certain regulations apply when making a claim through the MIB. Macks Solicitors will take the action necessary to secure compensation on your behalf without any cost to you or any deduction from the compensation you are awarded.

Passengers

If you have been injured as a passenger in a car that has been involved in an accident you could be eligible to claim compensation for your injuries even if the person at fault was the driver of the vehicle that you were in. Many people are understandably reluctant to bring a claim against a friend or a family member but, as it is the driver’s insurers who will be responsible for paying any compensation and not the driver themselves, this should not be an issue.

Making a Claim

Although you normally have 3 years from the date of your accident to make a claim, or until your 21st birthday if you were under 18, it is always advisable to contact a solicitor as soon as possible while the details are clear in your mind and in the mind of any witnesses to the accident. If you can, take photographs of the scene of the accident and any injuries you have suffered to support your claim.

Starting your claim soon after your accident will also give you early access to any treatment you need to aid your recovery. The sooner treatment is started the quicker the recovery and the better the long term prospects.

Insurers Offers

It is becoming increasingly common for Insurers to contact people who have been involved in an accident with their insured and make them an offer of compensation if they have been injured. They do this because it saves them the costs that would otherwise be incurred.

Because the insurers offer is made without the benefit of medico-legal advice it is likely to be lower than it would be if the full facts of the injuries and other losses were taken into consideration. The offer of an immediate settlement may be very appealing but you could end up with a good deal less compensation than you are entitled to.

Beware of Undersettling your Claim

We have recently settled a claim for a client who had been contacted by the insurers of the other driver and offered an immediate settlement of £1,200 for their injuries and other losses. Fortunately, our client sensibly called us for advice before accepting the insurers offer.

After obtaining a medical report from a consultant and arranging physiotherapy treatment, we negotiated a settlement of £5,600 on behalf of our client who kept the full amount of the compensation and was pleased to have called us before accepting the considerable lower offer made by the insurer.

Macks Solicitors are always happy to give advice, without obligation, to anyone who has been injured in an accident. Even if you are unsure that you can make a claim at all, call Macks Solicitors on Freephone 0800 652 4321 or complete the Quick Claim Form on the website and we will contact you. You won’t have to pay for either and our advice will be free of charge.
